Under Art. 13 sec. 1 and 2 of GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC O J L.2016.119.1), we inform you that:
- The Joint Data Controllers of your personal data are the Work Agencies; Contrain Group Sp. - The Joint Data Controllers have authorised a Data Protection Officer who can be contacted via e-mail: iod@contrain.pl.
- Your personal data will be processed under your given consent and under Art. 221 of the Labour Code, the provisions of the Act of 20 Apr 2004 on employment promotion and labour market institutions, the Regulation of the Minister of the Family, Labour and Social Policy of 7 Dec 2017 on the issuance of a work permit for a foreigner and the entry of a declaration on entrusting work to a foreigner in the register of declarations, and other implementing legal acts issued on the basis thereof, as well as Art. 6 sec. 1(a) of the GDPR, i.e. consent to the processing of personal data contained in your CV or other documents provided by the Candidate to the employer that are not expressly required by the labour law. With regard to personal data processed under the consent to processing thereof, a Candidate has a right to withdraw their consent at any time, but it shall not affect the lawfulness of the consent-based processing that has been carried out before the withdrawal. The Data controller shall process your data also in the forthcoming job recruitment procedures upon your expressed consent, which may be withdrawn at any time and based on legal acts concerning the employment of foreigners for the purpose of recruitment by the Joint Data Controllers. The information obtained under the foreigners' employment laws will allow the possibility of participating in the recruitment process to be checked.
- Your data may be disclosed to the following entities:
- the contractors of the joint data controller for whom the recruitment is carried out;
- competent state authorities, where it follows from the provisions of applicable law;
- to postal operators and courier companies - for correspondence with the candidate;
- to external service providers, in particular, IT services such as hosting, provision or maintenance of IT systems, e-mail and digital messaging;
- authorised employees and associates of the Data Controller or a joint data controller to the extent necessary for the performance of their assigned duties,
- companies providing business process services to joint data controllers.
- Your personal data will be processed during the time of recruitment process and for 3 months after its completion. Where your data is processed based on your consent to the use of personal data for future recruitment, your data will be processed for a period of 24 months.
- You have the right to access your data, to obtain a copy of it, to rectify, erase or restrict its processing, and the right to transfer your data to another controller. Your requests may be addressed to the e-mail address mentioned above or submitted in person at the offices of Contrain Sp. z o.o. ul. 3-go Maja 14a in Łódź.
- At any time, you have the right to withdraw your consent to further process your data. Your decision on withdrawing the consent may be sent to the abovementioned e-mail address or submitted in person at the office of Contrain Sp. z o.o. ul. 3-go Maja 14a in Łódź. Upon the withdrawal of your consent, the processing of your data performed before submitting your decision remains fully lawful.
- Providing your personal data to the extent described in Art. 221 Labour Code is mandatory. It is voluntary in the remaining scope, and it is a prerequisite for participating in the recruitment processes carried out by the Joint Controllers. Failure to provide your personal data will prevent you from participating in recruitment processes conducted by the Joint Controllers.
- You have the right to file a complaint with the authority competent for supervising the lawfulness and correctness of data processing. In Poland, it is the President of the Office for Personal Data Protection.
- Your personal data will not be transferred to the states outside the European Union and international organisations.
- Your personal data will not be subject to automated processing (decisions made by non-human algorithms), nor will it be subject to profiling.
